CAMBIOS EN LA REFORMA LABORAL 2025

Bogotá, agosto de 2025 — El pasado 25 de junio fue sancionada la Ley 2406 de 2025, una de las reformas más ambiciosas del país en materia laboral. Tras más de dos años de debate en el Congreso y múltiples propuestas ciudadanas, esta reforma se convierte en un hito normativo en Colombia.
Esta nueva legislación tiene como eje central la dignificación del trabajo, la reducción de la informalidad, la protección de sectores tradicionalmente desprotegidos y la regulación de nuevas formas de empleo. Como lo ha señalado la Corte Constitucional:
“El trabajo digno y justo es un pilar del Estado Social de Derecho” (Sentencia C-614 de 2009).

Principales cambios de la Reforma Laboral
Estabilidad laboral como principio general:
La contratación indefinida se convierte en la regla general. Los contratos a término fijo deberán ser de mínimo 1 año, salvo justificación objetiva. Los contratos por prestación de servicios se restringen.
Cambios en la jornada laboral:
La jornada nocturna ahora inicia desde las 7:00 p.m. hasta las 6:00 a.m. Se ratifica la reducción de la jornada semanal de 48 a 42 horas con ajuste anual progresivo y con aplicación total en 2026.
Plataformas digitales, trabajo en casa y teletrabajo:
Se reconocen derechos laborales a repartidores y conductores de plataformas digitales. El trabajo en casa y teletrabajo se regulan con jornadas claras, derecho a la desconexión y condiciones técnicas mínimas.
Reglamento Interno de Trabajo (RIT):
Obligación de actualizar el RIT en máximo un año. Debe incluir nuevas jornadas, permisos, protocolos disciplinarios, acoso laboral y modalidades de trabajo remoto, entre otros.
Nuevos permisos remunerados y licencias:
Se incluyen permisos por citas médicas de urgencia, reuniones escolares, calamidad doméstica, entre otros.
Pago de recargos dominicales y festivos:
Se incrementa progresivamente hasta el 100% del valor de la hora ordinaria asi: 80% en 2025, 90% en 2026 y 100% en 2027.
Protección en casos de despido injustificado:
Los trabajadores podrán solicitar reintegro en su cargo además de la indemnización. Aplica en casos de discriminación, embarazo, discapacidad y fuero sindical.
Fortalecimiento sindical:
Ampliación del fuero sindical, mayor facilidad de conformación y promoción de la negociación colectiva.
Inclusión laboral de personas con discapacidad:
Se amplían cuotas obligatorias de contratación y sanciones para empleadores a los que se les compruebe discriminación.
Contrato de aprendizaje:
El apoyo de sostenimiento será equivalente al salario mínimo y se refuerzan los derechos del aprendiz.
Impacto en empresas y trabajadores:
Para los trabajadores, la reforma fortalece ciertos derechos, procura garantizar estabilidad laboral y regula nuevas formas de empleo.
Para los empleadores, implica la necesidad de ajustar contratos, reglamentos internos y asumir mayores costos laborales.
Recomendaciones para las empresas:
- Revisar y ajustar contratos de trabajo.
- Actualizar el Reglamento Interno de Trabajo dentro del plazo legal.
- Capacitar a los equipos de Recursos Humanos en las nuevas normas.
- Implementar protocolos de prevención frente a acoso y discriminación.
- Solicitar asesoría legal especializada para cumplir con la ley y evitar sanciones.
